Agreement to Terms

By creating an account, accessing, or using the Victory Fitness mobile app or the Victory Fitness website (officialvictoryfitness.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our app, website, or services.

Accounts

You must create an account to use most features of the app, using Sign in with Apple, Google, or email/password. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must provide accurate information and promptly update it if it changes. You may delete your account at any time from Settings > Account > Delete Account.

Subscriptions and Billing

Victory Fitness offers auto-renewing subscriptions ("Victory Fitness Pro") billed through the Apple App Store (or Google Play, on Android). By subscribing, you agree to that platform's terms of service and billing terms. Subscriptions automatically renew for the same term unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device's App Store/Google Play account settings — we do not have the ability to process cancellations or refunds directly, as those are handled by Apple or Google per their respective policies. Any free trial will automatically convert to a paid subscription unless canceled before the trial ends.

Digital Products (Website)

Victory Fitness also sells standalone digital training plans and educational materials through our website. Upon purchase, you will receive access to download the product via a secure link sent to your email address. We use Stripe for this payment processing, and your payment information is not stored on our servers.

Due to the digital nature of these products, all such sales are final. However, if you have any issues with your product, please contact us at officialvictoryfitness@gmail.com within 30 days of purchase, and we will work with you to resolve the issue. Intellectual Property

Our Content

All content in the app and on this website, including text, graphics, logos, images, and software, is the property of Victory Fitness and is protected by copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Victory Fitness app and any purchased digital products for your own personal, non-commercial purposes. You may not:

Redistribute, sell, or share app access or purchased products with others
Modify, reverse-engineer, or create derivative works from the app or its content
Use the app or its content for commercial purposes without written permission
Remove any copyright or proprietary notices

User-Generated Content and Community Conduct

The app includes social features that let you post workouts, photos, captions, and comments, and interact with other users. You retain ownership of the content you post, but you grant Victory Fitness a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content within the app as needed to operate the social features you choose to use.

When using social or community features, you agree not to:

Post content that is unlawful, harassing, abusive, defamatory, or harmful to others
Impersonate any person or entity, or falsely claim an affiliation
Post fabricated workout data intended to mislead or deceive other users
Collect or harvest personal information about other users
Upload malicious code or attempt to interfere with the app's operation
Attempt to gain unauthorized access to our systems or other users' accounts
Infringe on the intellectual property or other rights of others

We reserve the right to remove any content or suspend or terminate any account that violates these terms, at our discretion and without prior notice.

Health, Fitness, and AI Coach Disclaimer

Important: The training plans, AI Coach responses, workout tracking, and fitness content provided by Victory Fitness are for educational and informational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment, and the AI Coach is not a licensed trainer, coach, physician, or medical professional. AI-generated guidance may occasionally be inaccurate or inappropriate for your specific situation.

Before starting any exercise program or acting on AI Coach guidance, you should:

Consult with a qualified healthcare provider
Get a physical examination if you have any health concerns
Listen to your body and stop if you experience pain or discomfort
Use your own judgment, especially regarding pace, load, and intensity recommendations

GPS-based metrics (distance, pace, route, elevation) and HealthKit-sourced metrics (heart rate, calories, VO2 max, and similar) depend on your device's sensors and Apple Health data, and may not always be perfectly accurate. Victory Fitness is not responsible for any injuries, health issues, or damages that may result from following our training plans, AI Coach guidance, or from relying on tracked metrics. You assume all risks associated with your use of our app and products.

Affiliate Links

Our website contains affiliate links to products on Amazon.com and potentially other retailers. When you click on these links and make a purchase, we may earn a commission at no additional cost to you. Our recommendations are based on our genuine opinions and experiences.

Third-Party Integrations

If you choose to connect a third-party service such as Strava, your use of that integration is also subject to that service's own terms of service. We are not responsible for the availability, accuracy, or practices of third-party services you choose to connect.

Termination

We may suspend or terminate your access to the app at any time, with or without notice, for conduct that violates these terms or is otherwise harmful to other users, us, or third parties. You may stop using the app and delete your account at any time.

Limitation of Liability

To the fullest extent permitted by law, Victory Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use our app, website, or products
Any unauthorized access to or use of our servers
Any interruption or cessation of transmission to or from our app or website
Any bugs, viruses, or other harmful code transmitted through our app or website

Indemnification

You agree to indemnify and hold harmless Victory Fitness, its owner, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our app, website, or products, or your violation of these terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website after any changes constitutes acceptance of the new terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
